While most of you were sleeping, a band of fearless, overly caffeinated patriots were pawing through the latest 3000 pages of internal documents from the Department of Justice. Clever Josh Marshall and Paul Kiel enlisted the aid of their readers in going over the copious amounts of material in this latest document dump:
Thousands of Pages
By Paul Kiel - March 20, 2007, 12:51 AMJosh and I were just discussing how in the world we are ever going to make our way through 3,000 pages when it hit us: we don't have to. Our readers can help.
So here's what we're going to do. This comment thread will be our HQ for sorting through tonight's document dump.
And oh, honey, it is a gold mine over there. There's already a motherlode of stuff piling up in the comments in Muckraker Land. Muck, meet rakes. Lots of rakes. Lots and lots and lots of rakes.
For you see, here at 2:32am, commenter "tralfmadore rocks" brings us verifiable evidence of the conspiracy originating from the AG's office on election night, and well, just read for yourself:
Email from Sampson to Elston, 11/7/06 6:21 PM.
"Please review and provide comments ASAP. I'd like to get this to Harriet tonight, if possible."
The document pasted into the email is headed, "PLAN FOR REPLACING CERTAIN UNITED STATES ATTORNEYS"
"Step 1 U.S. Attorney calls: On or about November 8-10, Mike Battle contacts the following U.S. Attorneys:" Listed are Charlton, Lam, [two blanked out], Chiara, Bogden, [blanked out], McKay, Iglesias.
Game plan for what Battle tells them
"Step 2 Senator calls: On or about November 8-10 (very important that Senator calls and U.S. Attorney calls happen simultaneously), Bill Kelley or appropriate Associate Counsel contacts the following Senators:" Listed are Kl re Charlton, [three blacked out], Ensign re Bogden, [one blacked out], Domenici re Iglesias.
NOTE that that's NINE bullet points for USAs to be forced out, but SEVEN bullet points for Senator calls. Maybe some of the blacked-out ones were to be consulted re two pushed out USAs; or maybe some USAs from states with two Democratic senators were to be forced out, so their input wouldn't be sought.
Game plan for Kelley script, including "If pushed, this determination is based on a thorough review of the U.S. Attorney's performance." Ask for 3 names.
"Step 3 Evaluation and Selection of "Interim" Candidates" set for Nov-Dec., for DOJ "in consultation with the Office of the Counsel to the President".
"Step 4 Selection, Nomination, and Appointment of New US Attorneys".Posted by: tralfmadore rocks

Now, if I'm not mistaken, this directly contradicts absolutely everything that Abu Gonzales has stated in sworn testimony. But just in case you had any questions about the execution of the mission, another Sampson email exchange takes us all the way to the top:

Importance: HighHarriet/Bill, please see the attached. Please note (1) the plan, by its terms, would commence this week; (2) I have consulted with the DAG, but not yet informed others who would need to be brought into the loop, including Acting Associate AG Bill Mercer, EOUSA Director Mike Battle, and AGAC Chair Johnny Sutton (nor have I informed anyone in Karl's shop, another pre-execution necessity I would recommend); and (3) I am concerned that to execute this plan properly we must all be on the same page and be steeled to withstand any political upheaval that might result (see Step 3); if we start caving to complaining U.S. Attorneys or Senators then we shouldn't do it -- it'll be more trouble than it is worth.
We'll stand by for a green light from you. Upon the green light, we'll (1) circulate the below plan to the list of folks in Step 3 (and ask that you circulate it to Karl's shop), (2) confirm that Kelley is making the Senator/Bush political lead calls, and (3) get Battle making the calls to the USAs. Let us know.

But what's that reference there to "Karl's shop"? What do you suppose is in the pies they sell there? (Here's a hint: "Soylent Green! Mmmmm, good people!") And here, look, look, once the heat is on, Kyle rounds up all his little elves and asks everyone for their vital statistics for security passes to the White House, so they can all go get their talking points implanted on tiny computer chips behind their ears:

Isn't that sweet? And there's much, much more. It's like an all-night Easter-egg hunt. You owe it to yourself to head over there while your coffee kicks in. See US Attorney Margaret Chiara's extremely thorny response to her own firing! Thrill to the intercepted emails between the fired attorneys as they strategize, fume, and swear out blood oaths of revenge!
1 10 Page 1
Cummins writing to his fellow fired attorneys about the message he recieved:
------------------
...if they feel like any of us intend to continue to offer quotes to the press, or organize behind the scenes congressional pressure, then they would feel forced to somehow pull *their* gloves off and offer public criticisms to defend their actions more fully.... I was tempted to challenge him and say something movie-like such as "are you threatening ME???"...
Oh, yeah! See, now this is getting downright scandalicious!
It's like a Zen riddle. If thousands and thousands of invisible rakes are all raking at once, do they make a sound?

Another drive by! I was just catching up on the morning reading. Just finished Christie’s post and was onto Africa, when I saw that TRex had been up all night. Now back to Africa. See you in a bit.

*blink, blink*
Good morning.
Lovely, like the sound of truth in the morning. Thanks all.
Is this what finally brings down the Bush Administration? One can only hope. I wonder how many comments are over at TPM now? Probably a thousand at least. There had to be 200 by 3am.
Hey TRex—
Great work!!
Oh TRex, you little scamp.
Go for it. Good boy!
I don’t know how new this is, but it seems to destroy Specter’s attempt to portray himself as an independent Republican capable of mediating between the Bush admin and the Democrats. (It was written right after the Democrats took over this year). He’s pretty clearly coordinating everything with the DOJ and the White House:
well good mornin’ to ya TRex !
love that snarky grin on the miner up top
my brain is a little scrambled from all the reading/googling
just how and why did these docs get dumped - being we know how open this WH is . . .
And here I thought you were up all night hitting the cooking sherry.
I know what will be keeping me busy today!
John Emerson @ 10
So do you suppose Arlen’s gonna “let” Rove testify? Real independent-like?
Hey Jane!! Great to see you!
I thought only 1,000 pages came out yesterday and the other 2,000 would appear today. Anybody?
this is EXACTLY how journalism will work in the internet age, especially as media corporations cut back on their own staff. kudos to talkingpoints, its readers and, um, oh yeah, fdlers!
Jane Hamsher @ 12
Um…that was me.
epu’ed from previous thread:
ok, this is not good.
here i am listening to c-span3 on the misuse of NSL’s in conyer’s house judiciary committee hearing.
and i read, via war and piece:
TRex: You and Mary4 down in Christy’s thread today spotted the same e-mails.
Bush/Rove can go ahead and zap Gonzales to try and insulate themselves, but it’s too late for that: We’ve now got evidence tying them into the conspiracy.
tommy yum @ 17
And you didn’t offer me any?
Dude!
I was so parched reading those documents until 3:00 am!
Jane Hamsher @ 12
Nope, but all the Girl Scout cookies are gone. Time to re-up. This is the time of year when little girls and their mothers find out what it’s like to be drug dealers.
On the one hand, damn, I love the tubes of the internets. On the other hand, damn, another day shot to hell. I’ll never find a job at this rate
The sound you hear is coming from the tiny shards of broken USCOJ statues now covering the floor, revealed by the zen rakes at work!

Hmmmmm…. Apparantly Dominici (NM) called Iglesias as part of a pre-arranged DOJ plan.

TRex! OT: thanx for posting the “Karma Hunters” video from the Pinker Tones a while back. That led to my seeking them out at SXSW last week. They were great!
Whoa– Maxine Waters questions the fact that the witnesses are not under oath and calls into question the testimony of the General Counsel of the FBI– Ms. Caproni.
Go Maxine!
(why on earth would Conyers not put them under oath?)
I think that the CBC may just save our nation.
selise @ 18 - I guess more & more of the admin folks are figuring out that not having a paper trail can come in handy for them. Gonzo and Scooter don’t do email, now the FBI can spy on you without any written record - nice.
TRex - mornin. Hot cuppa cappuccino ready for those who pulled the allnighter. Fresh roasted, good stuff. Tell me how you take it, and I’ll brew it for ya.
Jane - hope you’re feeling well!
Adie - reply to you downstairs. Really, I swear I’m gonna get to work right now. Really. I really mean it. Right now…
All 3000 pages were dumped yesterday.
OT: Hey, they found that missing 12 year old boyscout alive. YAY!

Hmm, first time I read that it said “Nope, but all the Girl Scouts are gone…”
Another cuppa, please.

Ah, the marvel of modern technology - archiving of emails!!
Another way to find the truth.
Way to go, TRex!
FYI:
The tpmmuckraker.com link from TRex above is live. The emails are still being disclosed on that sight as we type. So go there from time to time and refresh for the latest.
My own naive question: Why do these email writers save these emails when they should know it will get them in trouble later on?
TRex @ 30
Ok - I have a decaf blend and a caffienated blend rested just right for cappucino - I assume you’d like a straight up 3 shot leaded cap with a side of Thin Mints. Or, are you a Peanut Butter Patty kinda guy? (Do you know you can cut out the middle-girlscout and buy their cookies online?)
You definitely deserve cookies & cap for staying up reading those docs.
And Dubya comes right out and tells us he never e-mails cause he doesn’t want anyone all up in his bidness…
John Emerson @ 10
Any chance of referring Spector to the Ethics committee?
Arlen is sweating magic bullets at the prospect of Rove testifying - why, it simply can’t happen - ’cause if it did, someone might get around to asking just how it came to be that former Specter staffer Toleman (sp?) ( who happens t/b the guy who slipped the no Senate needed language in to rev. Patriot Act) wound up with the USA Utah pos. when WH wanted Kyle Sampson to have it
squeezed by Leahy/Schumer on one side and ol Turdblossom on the other - how’s that workin’ for ya Arlen ?!?!? bwaaahahaahaaa!
Alicia @ 43
Well, that, and he doesn’t know how to read or write, but hey…
Biodun @ 41
It’s the law. Preservation of records. But it does bring the amusing instance of Oliver North superspy thinking he was deleting messages when in fact he simply flagging them as deleted.
One of the still brewing stories on this one is that Rove apparently used an RNC or other email address for the dirtiest of his work on this. This would also be illegal. There’s a Presidential Papers Preservation law.
Phoenix Woman @ 38
Thanks, PW!
Biodun @ 41
i’m thinkin they will have invisible cyber chat just for them ASAP and all the r and d billed to some national security budget thing.
Jane Hamsher @ 12
Obviously, Trex works hard for his money! That’s why you pay him the big bucks, no?
angie @ 26
I caught the same thing–didn’t see the beginning so don’t know why they weren’t sworn in. Also didn’t understand why Conyers said “Too late.”
Innocent question: Why does DOJ get to “black out” portions of the docudump?
I just described this as peeking under the Bush admins document/email skirt. THANKS for all the data!
Alicia @ 43
Well, that’s the thing you have to realize reading Kyle Sampson’s emails. Abu is the invisible hand at work here. He doesn’t use email, but his right-hand man Kyle Sampson sure does.
Biodun @ 41
I’m pretty sure they have to preserve the emails for legal reasons. Some might also want to have them to cover their asses. Of course, officials like Gonzo who don’t have email - sure, some execs never learned it, but some avoid it intentionally in order to keep the written evidence at a minimum.
A lot of corporations have rules about what email you must retain and what email you must discard after a certain amount of time. I’m sure the government has a LOT of rules about what must be retained. Plus, I’m sure that techs could recover a lot of discarded emails if asked to do so.
I believe they are saved automatically. The question is, why would they write such things knowing they could be made public at any time. That would be Hubris. I can’t remember whether it was my mother or my English teacher who said, “never put on paper anything you would not want to see on the front page of the NYT.” Of course that was back in the day when they were known for their decent work.

Another important point is that some of these emails are from public email accounts like @yahoo.com. Uber-stupid.
jayackroyd @ 47:
Thanks!
John Emerson @ 10
Do bear in mind that we’re talking about the guy — Specter — who made the purges possible by altering the Patriot Act in December 2005 to allow the AG to hire/fire at will without Senate confirmation.
Sounds like Leahy needs to haul SJC co-chair Specter before the committee Specter used to chair.
Innocent question: Why does DOJ get to “black out” portions of the docudump?
This is yet another thing they’re screwing up. Because some of the redactions are being unredacted through independent reporting, it’s quite clear that redactions are not always for any reason that can be justified, but are being removed because they are embarrassing. This extends the news cycle some more as reporters try to piece together what’s been deleted.
Since one of the first deredaction was Fitz’s average rating, we know there has to be more stuff to be found. This will create pressure to redact less. They really are butchering their handling of this story–and it really does seem like the decider wants to keep his Gonzo.
Anyone that has ever accidentally wipe their hard drive knows just how much a good tech can recover. I also know, from buying used computers, that the gov’t has a special protocal before selling, to “super erase” (which has something to do with re-magnetizing) the hard drive.

OMG that idea is so delicious. It’ll never happen (heck, Specter is still trying to run the SJC himself, negotiating with people as to who will testify). Still, a lovely idea. His participation in this distasteful scandal is apparent.
Gonzales just cancelled a scheduled Thursday budget hearing meeting.
Mustn’t read too much into this, but…
La Urracca @ 24
Ditto!
Gnome de Plume @ 55
Email is just too efficiency enhancing not to be used. And, anyway, they were planning on not getting caught. Somebody’s epu’d comment a couple of threads ago said that they’d become complacent, since nobody had ever stopped them before, they just got into the habit of unconcern.
You know, keep in mind that they used a provsion of a law in a bill that was never knowingly voted on, and was apparently inserted by a staff member. I can’t imagine that, for instance, Feingold wouldn’t have said something about removing the confirmation process had he known about it.
Looks like it’s gonna be death by a thousand cuts rather than one giant scandal that brings these crooks and liars down.
TRex @ 53
Wow! It’s like the world’s biggest whodunit! I’m glad I like to read!
Gnome de Plume @ 55
AAAHHH–the email trap.
emails get saved routinely via backups. There are also legal reasons both at corps & in the govt for why they must be saved.
Now as to why people would say such things when they know they could become public . . . !!! I call it the email syndrome. Mostly it’s inherent in the medium. Haven’t you ever, while clicking send, regretted what you typed? Haven’t your pejorative emails ever been inadvertantly forwarded to the subject or your peeve? Even if you’re careful & paranoid, these things happen.
But with people in power it’s worse than that. When I was on Wall St., we had a compliance refresher meeting every year–things we could & couldn’t do. After the advent of email, we were told NEVER to put anything in email that we didn’t want to last forever & be open to public view. That was also to protect the company from being sued. Now what’s so hard about that? Yet, the only two securities analysts to get convicted after the internet bubble burst, got convicted on their own emails.
thanks cbl.
Well, Sen Specter will just have to recuse himself, now, won’t he. Bwahahaha!

Citizen TRex:
Thank God you are on our side big fella, but be careful of over indulging - indigestion in a theropod your size could get ugly.
Are you getting the feeling that things are moving almost too fast? At this rate we are gunna have resignations and one-way flights to Costa Rica and Paraguay before the end a the week! I am worrying that even if this ends in resignation or impeachment it might happen so fast we will miss some important stuff and some very bad folks will skate away to come back in another costume.
KEEP THE FAITH AND DON’T LET ANY OF THE BASTARDS CROSS YOUR YARD!!
jayackroyd @ 62
Just as I thought. Thanks.
jayackroyd @ 62
Exactly.
They might as well not bother redacting, because they simply don’t have enough people they can trust to do it right and in a timely fashion — we have far more eyeballs than they do, and we can spot their mistakes almost before they make them.
jayackroyd @
62
How much you wanna bet that Arlen is one of the Senators whose name is redacted?
The genie is out of the bottle. There is so much info flooding out already that I have vertigo.
The document dumpster is here if you feel like sifting through the garbage yourself.
But good luck getting through to the site. As you can imagine, it’s flooded with hits.

The first Laugh-Out-Loud moment I have had since Albertogate hit the wires. And I hate calling anything -gate, but I do like the sound of “Albertogate.”
Now, back to outrage.
Phoenix Woman @ 61
To me, that was the kicker. Comparisons with any other administration cannot be made, a la “Clinton did it tooooooooooooo!”
sooner or later you can bet dick dumps his new mcmansion and high tails it for somewhere without an extradition agreement.
karl also.
Sen. Feinstein made inquiries about Lam and immigration. I don’t know her motive in that, but if she was one of the ones putting pressure on Lam, her buddying up to Specter doesn’t look good.
It doesn’t look good anyway — what I mean is, was her involvement in the Lam case related to her willingness to provide cover for Specter?
squirrel hiller @ 83
Dubai?
I remember hearing from Congresswoman Linda Sanchez that the unredacted docs were available to members of Congress @ the DOJ.
That was last week, I would hope that the same holds true today and that the redacted names are not “protected” by fellow greedy persons of power.
Maybe we can get a two-fer –
Gone-zales and Specter decide to spend more time with their families on the same day.
BushCo is dangling Gone-zales out like chum hoping to protect the evil core that is Rove. But it won’t be enough. The
sharksrakes are circling now.Kinda like that moment in Godfather when Abe Vigoda asks a favor “for old times…”
Old times ended 11/7.
From the Judiciary Download Site if anyone wants to look at 7-1 the first 3 pages discusses filling empty US attorney seats and on page 3 it discusses the reasons why the statute on how to appoint US attorneys was amended…
- We are aware of no other federal agency where federal judges, members of a separate branch of government and not the head of the agency, appoint interim staff on behalf of the agency
- In early 2006, the statute that authorizes the appointment of interim United States Attorneys (28 U.S.C. 546) was amended by section 502 of Public Law 109-177 to eliminate the provision of a 120-day appointment and to allow the Attorney General to appoint interim United States Attorneys to serve until the nomination and confirmation of a United States Attorney under 28 U.S.C 541.
- The statute was amended for several reasons: 1) the previous provision was constitutionally-suspect; 2) some federal judges, recognizing the inherent problems, have refused to make court appointments, creating a situation where the Attorney General had to do multiple 120-day appointments (itself dubious under the statute, but something we had to do in some situations); 3) a small number of federal judges, disregarding the Constitutional issues, attempted to appoint individuals other than those proposed by the Department - in one case, someone who had never been a federal government official and hence had never been subject of the required national security clearance process, an unacceptable risk given the responsibilities and operations overseen by our U.S. Attorneys.
If you go to page six they begin to lay out the steps for replacing the 7 attorneys at the center of this brouhaha including who called who.
Unfortunately I’ve just now got to start working so I won’t be reading anymore of the 7-1 packet of info. It looks to be a good read though.
I hope an invasion of iran is not the “bright shiny keys” as a result of all of this baad news.
Kinda OT, but hurl alert - just listened to the Bug Man on NPR, feeling sorry for himself that us DFH’s had engaged in a specific plan to destroy him and criminalize politics. Asked if that wasn’t what the Republicans did, he said not at all - Clinton lied to a Grand Jury and was impeached for that act.
Can we please let him slither off in peace?
Holy Joe must be getting pressure from the GOP to switch now so they can shutdown these investigations.
jayackroyd @ 69
Question: Could they avoid “sending” the emails by writing up a draft, putting in the draft section of a proprietary email account, and then the “non-recipient” (who happns to have been given the same account name and password) could simply look into the “draft” box, read the message, and then delete it.
That way they could at least conceal the intended recipient of a message. But woukld that stuff show up in the computer files of a particular computer? Seems one would need to look at everey computer ever used by the individuals rather than their particular accounts.
This whole thing gives new meaning to the old saw: E-mails are a blessing; and a curse!
jess @ 89
crap! i momentarily forgot about that weasel!
Alicia @ 82
Ah, but they tried and tried…I see they were using that old chestnut as recently as 26-FEB-07, when they routed around a bunch of talking points and supporting documents in advance of the Senate Judiciary Committee hearing. One of their talking points compares the stats of the USA’s under Bush to those under Clinton: “Oh look how much BETTER these USA’s are than those confirmed under Clinton!”
Bullsh*t. The Senate under Clinton was a Republican majority; they confirmed them, not Clinton.
Gah.
Prairie Sunshine @ 86
It seems that Bush is using these doc-dumps to threaten Republican members of Congress…”Play ball or I’ll bring you ALLLLLLL DOWWWNNNN! Bwahahahahaa!”
Actually, no. Like EPU, I think long and hard before I commit thoughts to the written word. (You obviously didn’t have the same mother or the same English teacher I had.) Now, talking is a different story. I am told I am a horrid gossip.
