Bloomberg has a nice summary up of today's Libby hearing. It looks like Libby's got nothing but smoke and mirrors, and the judge is getting tired of the sideshow:
Lawyer Ted Wells, representing former chief of staff I. Lewis ``Scooter'' Libby, said about five witnesses would testify that agent Valerie Plame's husband, Joseph Wilson, revealed her secret job duties before they were disclosed in a 2003 newspaper column.

``I don't see how this is relevant to the case,'' Walton told Wells during the hearing. Any focus on Wilson's report would turn the trial into an inquiry on ``statements the president made in the State of the Union. You want to try the legitimacy of us going to war,'' the judge said.
Walton questioned how evidence about Wilson's findings would ``help the jury decide whether Libby lied to the FBI or the grand jury'' in the leak investigation. The judge said he'll issue a written ruling on the documents later.
If Walton thinks the whole thing sounds like bullshit now, wait 'til he sees the witness list. Can we assume the list will include Lt. General Tom McInerney and Maj. General Paul Vallely? They've made these claims before and Vallely's couldn't even stand up to Jeralyn's Lexis/Nexis debunking (as I recall this erupted around the same time as the "Joe Wilson is a French Spy" theory, Vallely eventually admitted he screwed up the dates and Sean Hannity told us that this made his story even more plausible). They're both big neocons, authors of the Regnery classic "Endgame: The Blueprint For Victory in The War On Terror," and as Digby noted:
These are all extremely creepy people involved in all kinds of neocon cloak and dagger fantasies. Just like Dick Cheney, whose idea of military leadership was gleaned from watching movies and TV series. They are part of the crackpot Cheney cabal. These two men specifically are Jack D. Ripper and Buck Turgidson come to life.
No wonder Wells didn't name them -- it would've killed all the PR value. Oh well, he can thank Hookergate for that anyway. But how could the Scooter Crew pass up the opportunity to continue the War on Wilson, even if their sources are incredibly sketchy? I guess it's all they've got. Bloomberg:

The WashPost has this beautiful quote from Libby’s lawyer, speaking to the judge today: “I’ve got a tough haul in front of this jury.”
No kidding! That’s almost as good as the quote from a Libby lawyer at a previous hearing that said that if the defense wasn’t allowed certain leeway in their defense, then the jury would convict. Sweet.
In the “Twists and Turns” thread, anon mentioned the possibility that Cliff May might be one of the anti-Wilson witnesses. He’s certainly made a point of saying that Valerie Plame’s CIA work wasn’t a secret, as stupid as that may sound.

May be a document that shows Scooter knew about CIA’s concern about Plame’s position prior to he conversations with Judy.
May be another Rove document other than the e-mail to Hadley that mentions Plame.
Shuster concluding that “tea leaves” all suggestion greater chance Rove will be indicted.
It went by very fast.

Came in on the middle of it. I’m hoping Raw Story comes up with a transcript or something. Shuster is back on the trail. All I caught was something about the evidence that’s being withheld from team Libby due to an ongoing investigation with regard to another official, i.e. Rove, will coming to a resolution shortly.
God, it sounded rather dramatic. Also Shuster said something about Fitz’s unusal body language and intent on not saying the name Rove.
Don’t know if that makes any sense, but that’s what I caught.

This is exactly the point I posted toward the end of the last thread. Thank goodness somebody with some power also has some sanity. I was beginning to think that power and sanity were mutually exclusive traits in our Federal government.
Shuster had a great report. He said Fitz’s body language was the most revealing about todays court appearance by the prosecutor. He said Fitz went out of his way not to mention Rover, and his body language made it obvious to him, something is up. I am paraphrasing but that is the gist.

New Pres accepts resignations of Rice and Rumsfeld and rest of Cabinet.
New interim goverment of national unity offered to Senate for advice and consent.
IMO, We are there, and this would happen if this were a rational world and there were any honor left in our political leadership. Otherwise . . .
I’d be willing to bet that this scenario, or something like it, is now being discussed,quietly, privately in/out of Congress and in the editorial board rooms of numerous major papers. The country can’t take this much longer, and everyone now knows it.

So, freakin’ Libby’s attorney disclosed that the CIA WARNED Libby about the implications of revealing Plame’s name! And this ocurred sometime after Libby’s June conversation with Miller but before his July conversations with her and Cooper! And he apparently “missed it by that much” (anyone remember Maxwell Smart?) being indicted on the original leak charge.

Me3 — agree that more public pressure is needed. But I also think that the political leadership can decide they need to make a change well before we have millions of people in the streets — and indeed, if we had millions, it’s not clear to me the outcome would be better.
I don’t know how this will end, but it seems someone is going to have to suggest a way out that allows the “other side” to accept the need for change. We have no precedent for what needs to be done.

Another post indicates that Judge Walton made the comment that matters pertaining to Rove would be coming to a resolution shortly. Apart from Rove’s possible indictment or from disclosure that Rove has flipped, what other inferences can be drawn from Judge Walton’s comment?

It’s probably not a good sign for Libby when the judge has to point out to your lawyer that your planned defense has nothing to do with the crimes with which you have been charged. From what has been posted, it seems like Judge Walton all but told Wells to forget about a Swift Boat defense.
It’s also painfully obvious that any defense based on the “common knowledge” of Valerie’s CIA employment should have the judge and Fitzgerald asking why Libby had to lie about what he did remember and claim to forget everything else if talking about Valerie was so benign.
I, for one, am chuckling over the knowledge that, between the lawyers, the paralegals, the research, etc., Libby is paying thousands of dollars per hour, and this is the best his team can come up with. Pretty indicative that he has no case, and there is no defense for what he did.

FWIW, Larry Johnson over at NO QUARTER is saying that Goss himself didn’t attend the parties only his top aide. He figures that Goss trying to explain himself out of the situation didn’t work with all of his other problems at the agency. Who knows…

I am so grateful to have seen a theater full of everymen and women singing this at the top of their lungs this morning. The song is great and it will speak to younger people in a way a blog may not. I spoke to a 22 year old young man at the bookstore today and he said he had “a number of things that needed to come before becoming politically active”. I showed him crashing the gate, gave him the fdl and kos sites (had on tshirt-fdl) and told him there was nothing more important. They would be another group to target in some way.

The way things seem to go these days is I read the real news in a liberal blog or journal. With varying amounts of time from months to days someone like Shuster gets ahold of it. Then it takes mainstream about another two weeks to even mention it.

Help for a newbie in the blogosphere, please. I don’t watch tv (sanity preservation), thus I am unsure who Shuster and Olbermann are. That teaser about Shuster noting something special about Fitz’s body language grabbed my attenion, I being a student of wildlife behavior of which body language is an integral component. So what’s it about? How do I read/see Shuster? Olbermann?
While I’m here, an observation: those who are driven by lust for treasure and power simply cannot grasp the fact that some are motivated by other things. They sneer at anyone who cares less for lucre than knowledge or true charity or the good of us all. I work for the state of Florida (pity me: BushX2), and nowhere is the disrespect for the absence of motivation by greed more apparent. Except in the Beltway, I reckon.
Not one of Fitzgerald’s adversaries will understand how badly they are overmatched by the combination of intellectual power and integrity this man exhibits. Don’t know how our society got so lucky, but let’s just take a collective deep breath and hope the stars align.
Further observation: Fitz has the gaze of an alpha wolf, and were it fixed on me, I would be very, very, worried.

Joe Wilson has said repeatedly that only a very small handful of people outside of the agency knew of his wife’s real profession. Those people were himself and Valerie of course, and Valerie’s mother (or something like that). If he had informed others, then he was not telling the truth. I tend to believe Joe Wilson and consider him a real hero. But I, for one, would like to hear from these people. Perhaps not in a court of law, but for the complete, truthful record. Let them step forth in public and tell their story. And let Wilson have a chance to rebut.

Help for a newbie in the blogosphere, please. I don’t watch tv (sanity preservation), thus I am unsure who Shuster and Olbermann are. That teaser about Shuster noting something special about Fitz’s body language grabbed my attenion, I being a student of wildlife behavior of which body language is an integral component. So what’s it about? How do I read/see Shuster? Olbermann?

Hypatia — Keith Olberman is a ‘talking head’ on MSNBC and currently is about the only one that the rational people, and blogpeople, can stomach … er watch.
I would bet you could find his website which discusses some of what he will have, or has had on his program. Shuster is a journalist that Keith has on quite freqnetly and seems very good.

Somewhat related. Libby’s attorney called Joe Wilson a “habitual liar” in court. Can Wilson sue for slander or liable? From what I’ve been told, no, he can’t. Written and/or verbal court related matters are exempt, or protected from what I understand.
If these five witnesses exist, and are credible, why hasn’t Wilson been indicted — we’re looking at five counts of violating the Intelligence Identities Protection Act, right?

A Wilson indictment would completely neutralize the whole scandal. They’d do it in a heartbeat if they had anything….

Let them step forth in public and tell their story. And let Wilson have a chance to rebut.
Our best guess is that at least two of these people have already stepped forward a long time ago. They made fools of themselves again and again. Perhaps we’ll see how more or less credible the others are. But with a track record like what has passed before there is little reason to expect anything other than what we have already witnessed. I just hope time and energy aren’t wasted on another batch of lies produced by the same batch of producers who relentlessly change the conversation by providing the stenographers with yet another batch of lies and liars.

I don’t watch tv either, but you can pretty much count on our faithful watchers to blog what’s happening. Schuster is a good guy, doesn’t seem to miss much, and isn’t afraid of the word prostitute, so stay tuned.

There’s something weird about that Raw Story error message.
“Currently awaiting resolution…” is not a standard DNS error or a File 404.
I know it’s not a DNS error, because when I do a Host Lookup, guess what:

It resolves.
If it was a database error, you’d see a MySQL error # or whatever database they were using. Geeks may be obscure to the uninitiated, but to each other, they tend to be pretty specific about the sorts of errors messages that they generate.
Else, how would you fix the problem?
Scanning around, it appears that the whole site is down. I am tempted to do an NMAP scan and see if Apache is running at all. That, by the way, is not, eh, totally, um… legal. So…
I’ll get back to you on that.

I certainly have no idea, not being an atty myself. However, I have heard of the possibility that the Wilson’s do have grounds for a personal law suit (on what basis I don’t recall), but they haven’t made any final decisions on that.

Jane Hamsher @ 6:32 pm (#63) - It is a mysterious process. The only thing I’ve noticed is that most, if not all comments I’ve made that required moderation had a long URL in it. I suspect it’s due to a bug/misfeature in the filtering software, because I’ve clearly been able to post comments with long URLs without triggering moderation.
BTW, do you think Andrea (Mrs. Greenspan) Mitchell is one of Wells’ witnesses? Now THAT would be funny!

I’m referring specifically to what was said or written in court filings etc. Everything else is fair game. So I’ve been told by an attorney and former judge several years ago in an unrelated matter ; )

Someone once likened me (under another nic and another message board) to Sharon Stone. Considering this was all on the basis of written exchanges I took that as a great compliment. I think Sharon Stone is really quite smart and quick at the draw. She totally cracked me up on Jon Stewart’s show, reducing him to almost babble, in a nice way, of course. :)

My guess is that either this is some sort of failover screen that the site goes to when things are, as we sometimes say in the defense industry, tango uniform. Either that or they have the site down for maintenance and that’s the web page they decided to put up in the meantime.
And yes, network and site administrators take a dim view of being scanned by someone they don’t know.
