
So, Tom Delay is leaving Congress in June. Stepping out of his Congressional race (If the Texas laws allow him to do so -- that's still a big question at the moment.). Getting outta Dodge, so to speak. Retiring Hammer, and all that.
Hmmm....doesn't that just get your little mind whirring on the possibilities? It does mine. And as I was pondering the abrupt end to the DeLay campaign, I remembered something.
Alexander Strategy Group is run by former DeLay senior staffers Edwin A. Buckham and Tony C. Rudy. Rudy served as DeLay's deputy chief of staff until 2001, when he took a job with Abramoff, and later moved on to join Buckham.Investigators are looking into whether Rudy aided Abramoff's lobbying clients while he was working on the Hill, the sources said, and are reviewing payments from Abramoff clients and associates to Liberty Consulting, a political firm founded by Rudy's wife, Lisa. The Washington Post reported last month that Rudy, while on DeLay's staff, helped scuttle a bill opposed by eLottery Inc., an Abramoff client, and that Abramoff had eLottery pay a foundation to hire Liberty Consulting.
Richard Cullen, an attorney for the DeLays, said Christine DeLay was hired by Buckham, an old family friend, to determine the favorite charity of every member of Congress. She was paid $3,200 to $3,400 a month for three years, or about $115,000 total, he said.
"It wasn't like she did this 9 to 5, but it was an ongoing project," Cullen said. He said Christine DeLay's work was commensurate with the project and had nothing to do with her husband or any official congressional business. "This was something that she found to be very interesting, very challenging and very worthwhile," Cullen said.
I can't help but think that the "Wives Club" has come back up again in the Federal probe. When the Feds have a target in their sites, and that target has close family or friends who are also involved in the criminal enterprise, it is a common practice to try and snare the outliers as leverage to flip the target.
Let's think about this in terms of the Sopranos for a moment: the Feds approached Adrianna as a means to get to Christopher. They threatened her with prosecution for something smaller unless she agreed to cooperate with them. They then wanted her to work on Christopher as their means to move up the ladder to Tony.
Now, things did not work out so well for Adrianna (think "bullet in the head" not so well), but in the DeLay case, you have a wife and a daughter who are rumored to have served as money funnels to Tommy Boy. And a family charity in play as well. Remember when he got all indignant about the press even asking about this last April? Well, I did remember, and it raised my hackles even then, because he protested way too much at the time.
The New York Times reported Wednesday that DeLay's wife and daughter have been paid more than $500,000 since 2001 by DeLay's political action and campaign committees, according to a detailed review of disclosure statements filed with the Federal Election Commission and separate fund-raising records in Texas....The Times said the payments to DeLay's wife, Christine DeLay, and his only child, Dani DeLay Ferro, were described in the disclosure forms as "fund-raising fees," "campaign management" or "payroll," with no additional details about how they earned the money.
And while sloppy bookeeping seems to be a hallmark of this rubber stamp Republican Congress and Administration (considering the raising of the debt ceiling...again...under their watch), that's a whole lot of questions about two members of the family over a considerable amount of time.
Let me be clear, campaigns hire family members all the time to do legitimate work. On both sides of the aisle. But proper accounting and record-keeping generally accompanies such hiring -- because obviously in this political climate, questions are bound to be raised now and then.
To have the DeLays be so vague, so sloppy, in their record-keeping over so many instances, really begs the question -- why? Were they hiding something?
Did the Feds find it?
It would explain a lot in my mind. I've had clients in my criminal defense days be much more willing to plead out or flip to keep their family out of harms' way. TPM and the Muckraker have had some great information recently on the Rudy plea and its potential fallout -- but where Christine DeLay and Danni DeLay fit into that, there hasn't been a mention, which also makes me wonder.
I've been wracking my brain trying to come up with motivation for DeLay to just walk away from his beloved power and money machine -- and the only puzzle piece that seems to fit is some sort of concern for his family. If DeLay's wife and daughter were in the crosshairs, who wouldn't he be willing to sell out to save them? Himself? Other members of Congress and the KStreet gang?
I really have no idea if this is the case -- it's complete supposition on my part based solely on my own experience defending clients in the federal criminal system and in observing how things went as a prosecutor. (btw, state prosecutors don't always have the resources to do this that the Feds do -- and let me tell you that the Feds don't mess around...) But it makes sense to me: DeLay is throwing himself in front of the bus to save his family from having to do so for him. There's an odd sense of nobility to that, I suppose, in some ways, although it would have been better all around to not ensnare your family in a criminal scheme of bribes, money laundering and who knows what else, in the first place. But hey, I've never been a felon, so what do I know? (snark intended)
Just my two cents, but if DeLay really is going to offer himself on the alter of felony plea and flip, I'd be very worried if I were a Democrat with a skeleton in my closet. DeLay is the sort of guy for which revenge is served hot and steaming, and he's likely got a score or two to settle. You think he's going down without dragging people with him? No chance. And DeLay has made it his life's work in Congress to know where every skeleton is buried. You think he won't sell out Dems on the way down before he coughs up Republican hairballs?
Fair warning. The Bugman may be exiting stage right, but I have this feeling that something wicked this way comes. Everyone hold on to your hats -- it's gonna get uglier if DeLay is cutting a deal. Clearly there is some serious cleaning that needs to be done on the Hill, but I'd be on the look-out for a surprise dust bunny or two in the process. DeLay is the sort of fellow who likes to make a grand entrance. Why would his exit be any different?

Prof — In my experience here in WV, he would need to get permission from the court. Generally, you are under Court supervision of some sort from the time the indictment is handed down. I can’t speak to Texas law, but that’s fairly common for most states — because I know we’ve had to deal with transfers of supervisory authority with pending felony trials in other states when we’ve had someone on, say, probation here. He wouldn’t be able to just pack his bags and go wherever he wanted in WV — and TX criminal law is prety stringent, so I’d say he’ll have to get some sort of Court permission. I’d look for the prosecutor to also request a higher bond amount, given the public announcement that they plan to cut ties with Texas.
I wondered about this myself, and of course the MSM is spinning this as DeLay taking one for the good of the party, safeguarding the seat, etc. I still think DeLay is in for some hard times, legally, and other than changing his status from public figure to private, I don’t know quite how his leaving the House will protect him – or his family – from the glare that will attend whatever further developments are pending.
Maybe this is really all about him wanting his gun back: wasn’t he livid because Texas law does not allow someone under indictment in Texas to own a gun?

I think you’re on to something big. If the Dems were all squeeky clean (which we know they aren’t) the Dem leadership in Congress would have been playing the ethics committee card over and over again, complaining of how the Republicrooks were all that was standing in the way of investigations. In truth, Ms. Pelosi et al have kept their powder much too dry for my taste. Speculation all along was that they didn’t want too much scrutiny on our side of the aisle either.
Bugman wasn’t in the exterminating business by accident, it seems to be in his genes so while he is stepping aside to spend more time with his lawyers, there’s no way he doesn’t bring out his little black book and find ways of tarring as many dems as he possibly can.
Frankly, I’d love to see an honest congress from both sides of the aisle. If we’ve got crooks, it’s time for some purging. No matter what, though the Republicrooks have a much deeper and larger cancer growing in their party than the dems do. If you don’t have power or anything to sell, who’s gonna buy?
If he does try to take down a Democrat, I’d like to think it’s more likely it would be a big-money DLC type, but I’ve always been an optimist.

I hope your right. The only Democrats that Delay should have anything more than a “heresay” knowledge of wrongdoing are Cuellar-like Democrats who deserve to be gone anyway. The WaPo might want to recheck their facts a little.
In Texas, you don’t have to BE a resident of a Congressional district to be elected in it, as per our Secretary of State. So if you want to move from a district you don’t have to live in, what does it matter?
The process for withdrawal isn’t all that complicated, either. It’s covered under our Election Code. Section 145.001 (warning: PDF file). Nothing there about reasons being required for filing, just how to file. Now if someone knows the statute that says you can withdraw ONLY under the WaPo’s criteria, I welcome them to point me in that direction. But it’s not in the place I always thought it would be, which is under our election code.
Anyway, I think they’re confusing the law for our own state legislators, who DO have to live in their districts, with the law for US Congressional reps.
But I could be wrong…

Been stewing about this since I heard about it as I awoke to NPR coverage…good point, it could be he’s decided not to pull a Fastow on his sweetie.
But maybe his beloved spouse wasn’t going to let him pull a Fastow on her, might have threatened him with squealing if he gave her up to the fibbies. What’s the chances we’ll see news of an amicable separation due to stress from the scrutiny, with Mrs. DeLay staying in/keeping the residence in TX, and Mr. DeLay moving to VA by himself?
But this scenario still doesn’t ring right. My gut tells me the fibbies breached a firewall of sorts, and DeLay now knows the entire system is exposed, even though we out here can’t see the actual point of penetration and the degree of damage done or impending. I’ve been waiting for a link between the Noe-Coingate scandal and the Abramoff scandal, too; there was too much money involved not to be directed to somebody or something with a high level of power. At some point this entire mess becomes intertwined by a couple of key nodes in the network, perhaps even Noe’s wife and other wives; discovering the relationships could turn this whole mess into one enormous RICO action that envelopes the White House.
If the Bug Man has dirt on Dems, let him bring it on. We need to get rid of whatever crooks are on our side, too. And the sooner the better.
Congressional residency (IANAL) : you do have to live within your State but not necessarily within your District. Moving officially out-of-state would make you ineligible to be on the ballot.

You are clearly on to something. A friend of mine who is a Dem staffer has been saying for years that to get to deLay they needed to go after his daughter. It looks like they may have finally wised up and done so.

He’s had plenty of opportunity to engineer the revelations of Democratic corruption, and the lack of any real effort to mount a Democratic smear campaign has to mean that whatever he might have on them is dwarfed by what lurks in his own closet. I mean, why wait until you’re staring at an indictment to start lobbing brickbats at Democrats?
Look, for example, at the feeble attempt to pull Democrats into the Abramoff scandal. That went nowhere, and this time, the lack of facts to support the accusations against Democrats actually killed the whole thing.
It’s my opinion that Republicans are now so identified with major corruption and crime, along with incompetence and manipulation of information and intelligence, that no one – other than the solid GOP base – is being swayed by attempts to tar Democrats with the same brush. Even that lame statement from DeLay about a 2007 Democrat win meaning higher taxes, etc. falls flat.
I agree that his ego is what has kept him in the game this long, and that he never really believed he would have to justify or defend his actions.
Congress will feel cleaner the moment he leaves.
I would think the Repugs would have already outed any big Dem scandal by now. They have been painted into the corruption corner and would have mentioned any Dem by now. They need a “see everyone is doing it” desperately. I really wonder if we should give up on our side so soon.

Does he get to keep that money? What will be the pressure to return it or turn it over to the next fellow? How do we rachet up that pressure.
It seems to me that if he is leaving because of polling, and the polling was done in advance of the deadline, that makes a prima facie case for fraud, or at least ground for a big stink if he decides to try to keep it and use it for his defense fund.

second that question — surely election law does not permit a candidate who terminates his run for office to simply transfer the funds he raised specifically for campaigning to some other coffer such as his legal defense fund? Doesn’t all the money he has raised and cannot document spending on campaigning thus far have to be returned? Of course, that gives those rethugs a chance to give the money to someone else (alas) but at least it puts the Bug Man in an even tougher spot when it comes to paying the legal bills — the less he has, the more he hopefully suffers…
This congress needs a Roto-Rooter enema. I’m quite confident the majority of the crooks are on the red side of the isle, but if there are crooked Democrats, I want them out even more than I want the Republicans out.

The family theory sure sounds good to me but I was wondering if this news will have any affect on the Supreme Court’s evaluation of the legality of the Texas redistricting. If the man who pushed that through–by any means necessary–has just resigned in scandal, doesn’t that make the whole enterprise look a little less appealing?
Of course, it has always looked illegal to me–the demise of DeLay is just the icing on the cake. But I understand that the Supreme Court has been leery of making big decisions on redistricting battles–might this give them just a little more encouragement?

Delay’s kinda covered his hide with the bluster that he would have won the seat, and, quite frankly, he could have. Fort Bend/Sugarland is just the kind of place that would elect a Delay in the first place. Still, we’d never know if his polling data was right or wrong without the election results. It would be very hard to prove intent in that one. I’d think most of those in power in Texas would give him the benefit of the doubt.
As for the people who might be a tad upset about losing their “hammer” and the money they gave him? Well, that’s another matter.
The normal rubes, yeah, they’ll be a bit peeved, but they’ll calm down if you give them the typical modern Republican running for that seat. You know, one of those guys who rails against the usual suspects while quoting the bible.
I smell the old boys network in here. They want him out; they’re afraid a Dem really WILL take that seat if Delay stays in there, so they’d rather take their chances with a lesser-known Republican.

Rather than family protection, might it simply be the case that his lawyers sat him down and said, “Yo, Tommy, now that Tony Rudy’s pleaded guilty, you had better focus on your legal defense or you’re going to spend some serious time behind bars. It’s going to cost you time (which you don’t have if you keep flying to DC), and lots of money.” And if it’s true, as some in the media are saying that compaign contributions can be converted to a legal defense fund . . . well, that’s pretty good incentive, too. Don’t you think?

Delay won the Primary so his name would be on the ballot for the fall General Election. He simply can’t take his name off. By moving out of state officially, his name would be taken off the ballot by the authorities - a replacem,ent would be chosen for the fall election by whatever system the Texas election laws provides (the GOP would name somebody). These arcane laws can be immensely powerful - I’ve been involved in some Hoosier political battles involving successors and ballot-replacements! Lots of fun…

You hit the nail on the head. I think he is doing this for his family.
But,by exposing as many Dems as possible,he is out to create an atmosphere that ALL of Congress is doing it. Besides being a vindictive exterminating politician, this would most likely Depress the Democratic Voter Turnout.
When voter turnout is low, the far right ALWAYS has an advantage, especially when “called to battle”. That advantage is what keeps the Rubber Stamp Right Wing Republican Congress in power.
So Delay cranking up the Far Right Outrage without having to actually run a campaign this election cycle could be quiet damaging to our chances in 2006, especially if the Feds start squeezing him.

You’re right abou the possibility of a deal like this, of course, but this bargaining was always a given in the plea negotiation process. The more compelling question is “why step down now?” My defense philosophy is that there is always plenty of time to delay being “guilty.” For the answer I think we need to look at whether this timing provides the TX Republicans with an appointment opportunity for the Bugman’s seat, rather than requiring an open election, so that whomever is appointed could then run as an incumbent wth enough time to distance hiself from Bugman before havign to run. That’s “why now.”

I think Carolyn Urban was just using Leahy as a “Fitz” substitute at the start of the thread. (He did kick some serious ass in the censure hearing on Friday. Good on him!) First thing I think of is why now? I believe it has something to do with the ability to run a special election, surely.

I agree that major dirt on Dems is probably not so major, or something surely would have been leaked to back up the “everybody does it” propaganda line. But it also makes sense that something is being held back that has helped keep the Dems intimidated re using the House ethics process.
Until, of course, you look at how the Dems are intimidated across the boards. Every GOP failure under the sun seems to have instilled fear in the Dems, why not their ethical failures as well?
So, my speculation here is definitely blurred, except for the logic I articulated before: that whatever DeLay may have on Dems, and whatever his desires may be, if he’s going to start talking deals, it’s the GOP dirt that’s already in focus that’s going to come out first. It’s just the way the logic of prosecution would work–and that’s the logic that would prevail, despite what DeLay would want.
All this, of course, means I think that redshift has it wrong. Christy is defintely (to my mind) talking about the logic of prosecutors putting on the squeeze. And all the innuendo in the world won’t help DeLay one bit in this regard. If anything, it would just piss off the prosecutors even more, I would suppose.
Plus, being out of Congress and all, he would not have nearly as much attention for his smear jobs.

It’s not surprising that Delay would pull out of the race- if he was a sure loser which is apparently the case. What’s surprising is that he will not serve out the last nine months of his current term- which means a special election I guess- or an open seat for six months. Strange- and he just won the primariy- what- a month ago? Why didn’t he drop out earlier?
After reading the factual basis submitted for the Rudy plea agreement, I think they had PLENTY without Big Missy DeLay. Multiple (as in HEAPING) counts of mail and wire fraud, and they only charged Rudy with a single count of conspiracy? Means Rudy flipped hard in exchange for the reduction.
So Rudy was the breached firewall; once he cracked, it was all over. He signed the plea agreement AFTER the primary, after all kinds of money had been donated to DeLay’s campaign. How fortuitous the timing, yes? Downright serendipitous…makes me wonder who generated all the noise in TX about DeLay threatened by a Repug challenger in the primary, especially since the primary came out so one-sided. Hmm.
DeLay is also in striking range of RICO prosecution, too, if I read the Rudy factual basis document correctly…O frabjous day! Callooh! Callay!

Sure, it’s mostly bullshit - the Dems would raise taxes, but on rich people (who are only paying 15% these days, less than most working people when you toss in the payroll tax), and they might actually start fighting the War on Terror, which Bush hasn’t done anything about (other than give a lot of speeches) since bin Laden slipped through his fingers in 2001.
But an “unconstitutional impeachment” ?? That’s so close to impossible, all you can do is laugh. How could you do an unconstitutional impeachment - have the Senate vote to impeach, and do the trial in the House? It would take something along those lines for an impeachment to violate the Constitution.
Sheesh, what a dummy (as well as a world-class asshole). Good riddance to bad rubbish.

Delay was–curiously- a darling of the religious right. They have been threatening lately to sit the next election out (as a “hammer” to compel goopers to enact some of their stranger agenda items).
The “leaders” of the religious right are duly cynical and have learned how politics works. The “rank and file” may be about to learn that sayin “Lord, Lord” constantly does not guarantee a man of good character- in fact just the opposite. They could have learned that from the Bible- but that’s one of the parts that they don’t read.
Delay is swearing up and down that now the Republicans will win his seat, becuase Deomcrats will not give national support to Nick Lampson. Is there anything that this blog can do to change that? It would be an awesome double slam if Delay stepped down and Nick Lamson won.

Delay was an “important cog” only while there was a gooper machine. When they had control of the money and a 90% JAR president–it was pretty easy to twist arms- no gooper was going to buck that kind of system..but things have changed. Now every gooper cockaroach is scrambling to save him/her self.
basic principle: no Representative can ever be appointed - all must be elected.
There will be 2 elections in TX-22 this year. One will be a special election to fill the remainder of Delay’s unexpired term. The 2nd will be the regular fall election. Texas election law will determine how the replacement Republican candidate will be selected to appear on the fall ballot to replace Delay. Lots of internal-Party power politics !!!
If DeLay had dirt on the Dems, why wouldn’t he have spilled it by now? I’m not saying it isn’t possible. Very likely it is. But I suspect the dirt is personal not political. Let’s face it, Dems don’t have anything to offer. There’s no power and the money flows away from them, not toward them.
We ain’t perfect and there are plenty of temptations for abuse but unless you know something I don’t, I suspect there isn’t a whole heck of a lot to report. It would have to go back over ten years to be really significant.

When he redistricted Texas, Delay felt that his position was so strong that he could afford to give up his old totally safe disctrict in exchange for one that was not quite so safe- so his wounds are almost totally self inflicted.

Iraq’s interior ministry is refusing to deploy thousands of police recruits who have been trained by the US and the UK and is hiring its own men and putting them on the streets, according to western security advisers.
While I agree completely that any corrupt Dems would be good riddance, we do need to take any such accusations (even against people we really don’t like) with a huge grain of salt. If DeLay and the GOP try to take down Democrats, they’re going to use PR to make any appearance of impropriety into something comparable to Abramoff, to feed a “they’re all crooks” defense for the elections. Remember the so-called “scandals” of the Clinton era, like the White House travel office, and make sure there’s real meat before buying into any claims about supposedly corrupt Dems.
